if they repeal county wide zoning can the windfarms be put up with only the landowners permission needed?

I believe so. Zoning protects the land owner and the developer from lawsuits.
With zoning, any potential lawsuits would be filed against the county first, for allowing the situation that prompted the filing of a grievance.
Without zoning, the responsibility to defend against a claim would be borne by the landowner that allowed such activity and the developer whose actions provoked such a filing.
I have heard from some that if zoning is not in place that Iberdrola is not interested in proceeding. I have heard from others that Iberdrola has forged ahead in other areas where there is no zoning. Which of these two contrasting statements is the truth is only known by Iberdrola.

I think you are correct unless it's within the 3 mile 701 zoning radius from the City of Hays.

I would hope we could get smart commissioners that would come up with an adequate county wide zoning to protect residents in this county.
