wal-mart ...... not as friendly as they claim.... it's all about profits anymore, it doesn't matter who gets crushed along the way

JACKSON, Mo. -- A collision with a semi-trailer truck seven years ago left 52-year-old Deborah Shank permanently brain-damaged and in a wheelchair. Her husband, Jim, and three sons found a small source of solace: a $700,000 accident settlement from the trucking company involved. After legal fees and other expenses, the remaining $417,000 was put in a special trust. It was to be used for Mrs. Shank's care.

Instead, all of it is now slated to go to Mrs. Shank's former employer, Wal-Mart Stores Inc.

Two years ago, the retail giant's health plan sued the Shanks for the $470,000 it had spent on her medical care. A federal judge ruled last year in Wal-Mart's favor, backed by an appeals-court decision in August. Now, her family has to rely on Medicaid and Mrs. Shank's social-security payments to keep up her round-the-clock care.

how can that be. that makes me sick, no wonder i don't shop there. I just pray the ma and pop shops hang around longer.

yeah , the watch-word is "subrogation". thats the term used in insurance policies to define their right to your lawsuit awards. of course don't confuse that with the term "Monthly premium", thats just what you pay for allowing them to subrogation in the event you are hurt due to someones elses carelessness and you sue and win. Insurance used to be a gamble....... they were betting that you wouldn't get hurt or have anything bad happen while they were getting you to bet that something bad would happen. They figured that if they got enough people to bet ( sign up) that they could spread the losses and still make big bucks on the deal. What they found was, they were wrong. So they invent terms like pre-existing conditions, riders, subrogation, decuctible.... you get the idea...... these are all ways to take the burden off of them and put in back on the insured while still collecting that "premium". It's a lot like playing cards with someone that sets all the rules to favor them, they hold all the high cards, and, in th event you happen to win, they change the rules to stop that from happeneing again.


Don't worrk about all that fine print, it's just a bunch of legal mumbo-jumbo, just sign on the dotted line and make the check payable to ........ affraid affraid affraid
