Why? It wasn't in there during the first half of the 1900's. It was only added in the 50's to differentiate America from those "Godless Communists" as they were called. It wasn't in there during WWI and WWII. Does having it in there now make us more morally fit than the generations that got us through the great depression, financial collapse, the dust bowl, and two world wars?

So long as it's defined that there must be intent to cause real harm. Making all inflammatory speech a crime would gut the 1st amendment
