The Consumerist blog noticed Sunday that the social-networking giant had quietly made a change to its user Terms of Service (TOS) on Feb. 4.
Facebook now declares that it has a perpetual license to use anything you post to your own Facebook page — even if you terminate your account.
Here's the licensing part of the legalese, which sounds bad enough:
"You hereby grant Facebook an irrevocable, perpetual, non-exclusive, transferable, fully paid, worldwide license (with the right to sublicense) to (a) use, copy, publish, stream, store, retain, publicly perform or display, transmit, scan, reformat, modify, edit, frame, translate, excerpt, adapt, create derivative works and distribute (through multiple tiers), any User Content you (i) Post on or in connection with the Facebook Service or the promotion thereof subject only to your privacy settings or (ii) enable a user to Post, including by offering a Share Link on your website and (b) to use your name, likeness and image for any purpose, including commercial or advertising, each of (a) and (b) on or in connection with the Facebook Service or the promotion thereof."

| so ok..... a mom puts a photo of her child on to share with her friends and thru this new policy, she is browsing thru a magazine and lo and behold, there is her child in an ad for diapers...... or as a parent you find a photo your child placed on their facebook page selling kool-aid.... a minor is not legally able to enter into a binding contract and yet by facebooks rules, by clicking on the "I AGREE" button they are illegally doing just that. I look for a huge lawsuit to come out of this and facebook will go into bankruptcy and disappear, as they should after this little stunt | |

makes me really glad I never utilized the "service" Why is this a surprise? Service providers like AOL and Yahoo have been spying on and trying to control it's users computers for a long time. Not only does it mean they have a right to search and use your posts for profit, but also to turn the info over to any attorney, cop, or government boys that ask for it. No warrants required. Hell Luke, don't we know a kid with well over 600 facebook pals? | |

| heres another scenario....... you meet with some old friends , have dinner and some photos are taken that include you...... these photos end up on your friends facebook page and gets sold by facebook to some ad agency and ends up in all kinds of magazines selling whatever.... you were never a member of facebook and never agreed to their policy on this.... you should have the right to compensation for use of your likeness in that ad. Can you sue?? according to their user agreement facebook members are only allowed arbitration per their agreement. | |

You are liable for the actions of your child. You don't want this to happen you gotta monitor their internet usage. Don't get me wrong, I agree that the policy stinks. My opinion is that if they expect this to be a binding contract they are going to have to forbid accounts to minors. | |

| I was watching this mornings news and saw a segment on about the reversal of the terms of use policy by facebook. I think it was wise on their part, they said it was changed back after tens of thousands of people raised hell with them and cancelled their accounts. Maybe "we the people" do have a voice afterall. | |

| Come to a surprise to most of you.....whatever you post on the internets will never go away. They are all logged and stored. Thousands of times....Do you not see the BOTs that come in here? What do you think they are doing? Logging what goes on, recording and storing the data. |
